Terms of Service

These Terms of Service ("Terms") are an agreement between you and Luxmore Group Realty ("Luxmore," "we," "us," or "our"). By accessing or using Luxmore.ai, a Luxmore public form or AI feature, or Luxmore Homes in ChatGPT (collectively, the "Services"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services for an organization, you represent that you have authority to accept these Terms for that organization. A separate signed agreement for brokerage, representation, employment, platform access, or other professional services will govern that relationship and will prevail if it conflicts with these Terms.

You must be legally capable of agreeing to these Terms. If you are using an authorized account, you must provide accurate information, keep credentials and devices secure, use only the permissions assigned to you, and promptly notify us of suspected unauthorized access. You are responsible for activity carried out through your account to the extent permitted by law.

We may deny, suspend, or terminate access to protected tools where reasonably necessary for security, compliance, non-payment under a separate agreement, misuse, or loss of authorization.

The Services may include property and project discovery, listing search and detail views, maps, comparisons, market content, agent pages, inquiry forms, AI-assisted search or conversation, and authorized operational tools. Features may vary by location, platform, account, data availability, and service status.

Luxmore Homes in ChatGPT searches active British Columbia listing data, displays listing details and images, and may analyze nearby schools, shopping, transit, healthcare, or parks for a selected listing. It does not provide checkout, payment, offer submission, booking, document signing, or in-ChatGPT communication with an agent.

Using the Services, viewing a listing, receiving an AI response, or submitting a general inquiry does not by itself create a client, agency, fiduciary, brokerage, employment, or other professional relationship with Luxmore or any displayed agent. Such a relationship arises only through an appropriate direct engagement and, where required, a written agreement and regulatory disclosures.

The Services do not provide legal, financial, tax, mortgage, insurance, appraisal, inspection, engineering, environmental, planning, or other regulated professional advice. Consult qualified professionals before making a decision or entering a transaction.

Listing, market, project, and agent information may come from Luxmore, CREA DDF, real estate boards, listing brokerages, agents, developers, public records, and other providers. Although we aim to present useful current information, data may be delayed, incomplete, duplicated, changed, withdrawn, or inaccurate. A displayed listing is not a promise that a property remains available or that a seller will accept any terms.

Before relying on important information, verify it through the listing brokerage, an appropriate professional, official records, and an on-site review. This includes price, status, dimensions, floor area, boundaries, title, taxes, strata information, zoning, permitted use, condition, defects, schools, catchments, transit, amenities, development plans, and photographs.

Listing content is provided for your personal, non-commercial property search unless the applicable data owner expressly permits another use. Notices, attribution, and copyright displayed with listing data must be preserved.

AI features can misunderstand a request, omit relevant information, return stale data, or generate incorrect statements. AI output is provided to assist discovery and must not be treated as a guarantee, valuation, recommendation, or substitute for independent verification and professional judgment.

Do not use AI output to infer or rank neighbourhoods by safety, crime, school quality, protected characteristics, demographic composition, or whether a community is suitable for a particular type of person. Luxmore does not make those determinations through the Services.

You are responsible for reviewing a search interpretation and correcting filters that do not reflect your intent. Do not submit confidential, privileged, or unnecessarily sensitive information in prompts.

Maps, geocoding, routes, and nearby places rely on third-party data and may be inaccurate or incomplete. Nearby-facility results represent provider observations within a selected radius at a point in time. Distances may be straight-line measurements rather than travel distance, and the absence of a result does not prove that a facility does not exist.

Nearby results do not verify admission, catchment, service quality, accessibility, hours, capacity, route safety, future operation, or suitability. Confirm material details with the facility, municipality, school district, transit authority, mapping provider, or another authoritative source.

The Services may depend on or link to third-party platforms, data, maps, AI systems, websites, or applications. Your use of them may be governed by separate terms and privacy policies. Luxmore does not control and is not responsible for a third party's content, availability, security, or independent handling of information.

When you access Luxmore Homes through ChatGPT, you also use OpenAI's service and agree to any terms that apply between you and OpenAI. A change or outage affecting ChatGPT or another provider may limit Luxmore features without notice.

If you submit an inquiry or contact details, you authorize Luxmore to use the information to respond, route the inquiry, send requested materials, and contact you through the methods you select. Submitting an inquiry does not guarantee a response, representation, property availability, showing, financing, or transaction.

You are responsible for providing accurate contact information and for ensuring you are authorized to provide any information about another person. You may ask us to stop non-essential promotional messages as described in our Privacy Policy or in the message itself.

You may use the Services only lawfully and in accordance with these Terms. You must not:

• Scrape, crawl, harvest, bulk-download, mirror, redistribute, resell, or build a competing database from listing or service content without written permission.
• Use automated means that place unreasonable load on the Services, evade rate limits, or bypass access, security, attribution, or technical controls.
• Reverse engineer, probe, disrupt, introduce malware, attempt unauthorized access, or interfere with another user's access.
• Submit unlawful, deceptive, infringing, discriminatory, threatening, or harmful content, or impersonate another person or organization.
• Use the Services to make prohibited housing decisions, infer protected characteristics, facilitate unlawful discrimination, or violate privacy, intellectual-property, real estate, or other laws.
• Misrepresent AI output or listing data as independently verified by Luxmore when it has not been verified.

The Services, excluding content owned by third parties, are owned by or licensed to Luxmore and are protected by intellectual-property laws. Subject to these Terms, Luxmore grants you a limited, revocable, non-exclusive, non-transferable licence to access the public Services for personal, lawful use.

You retain any rights you hold in content you submit. You grant Luxmore a non-exclusive licence to host, process, reproduce, and transmit that content only as reasonably necessary to provide, secure, and improve the requested Services and to meet legal obligations. You represent that you have the right to submit it.

Feedback may be used by Luxmore without restriction or compensation, provided we do not publicly identify you without permission. Third-party listing data, trademarks, maps, photographs, and other content remain subject to their owners' rights and notices.

Our Privacy Policy explains how we handle personal information. By using the Services, you acknowledge that information will be processed as described there and by any third-party platform you choose to use.

We may add, change, suspend, or discontinue a feature, data source, or part of the Services. We do not promise that the Services will always be available, uninterrupted, secure, or compatible with every device or platform. We may perform maintenance and impose reasonable usage limits.

We may update these Terms by posting a revised version and changing the date above. Material changes will apply prospectively, and we will provide additional notice where required. Continuing to use the Services after revised Terms take effect means you accept them.

To the maximum extent permitted by law, the Services and all content, data, search results, maps, and AI output are provided on an "as is" and "as available" basis. Luxmore disclaims warranties and conditions, express, implied, statutory, or collateral, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, and that the Services will be error-free.

Nothing in these Terms excludes a warranty, condition, right, or remedy that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.

To the maximum extent permitted by law, Luxmore and its directors, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, opportunity, data, goodwill, or business, arising from or related to the Services, even if advised of the possibility.

To the maximum extent permitted by law, Luxmore's aggregate liability arising from or related to the public Services will not exceed the greater of CAD $100 and the amount you paid Luxmore specifically for the affected digital Service during the twelve months before the event giving rise to the claim. This limitation does not apply where prohibited by law or to liability that cannot lawfully be limited.

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any right you have under mandatory consumer law, the courts located in British Columbia will have exclusive jurisdiction over disputes relating to these Terms or the Services.

Before starting a formal claim, please contact us and describe the issue so the parties can try to resolve it informally. Nothing in these Terms prevents either party from seeking urgent injunctive relief where appropriate.

If a provision of these Terms is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. Headings are for convenience only. You may not assign your rights under these Terms without our consent; Luxmore may assign these Terms as part of a reorganization, financing, or transfer of the relevant business, subject to applicable law.

These Terms, the Privacy Policy, and any applicable feature-specific or signed agreement form the agreement governing your use of the Services. They do not create third-party beneficiary rights.
