The case centered on allegations that Zhang's unit was rented out on Airbnb or similar platforms during five separate occasions between November 2023 and February 2024, violations that her building's bylaws explicitly prohibit. Tribunal member Alissa Reynolds issued her decision on July 27, 2026, finding that while short-term rental activity did occur, the strata corporation had fundamentally miscalculated its fines and failed to follow proper notification procedures under the Strata Property Act.
The strata's evidence included security camera footage from the building's lobby and elevator showing people with luggage and a cleaner with supplies, combined with key fob data connecting these individuals to Zhang's unit. Reynolds determined it was "more likely than not" that the property was used for short-term accommodation, rejecting Zhang's claim that she had a legitimate long-term tenant in place. The tribunal also found Zhang's credibility damaged when she admitted a tenancy agreement she submitted had been backdated, and determined she "knew or ought to have known" about the short-term rental activity given the numerous bylaw infraction notices sent to her email.
